1. Who you're contracting with

Firebid ("Firebid", "we", "us", "our") is operated by Carey Ross Lee, a sole trader based in Australia. By accessing or using firebid.com.au, the Firebid mobile experience, or any related service (the "Service"), you enter a binding agreement with Carey Ross Lee trading as Firebid.

2. Acceptance

By creating an account, browsing listings, bidding, listing items for sale, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter this agreement.

3. What Firebid is

Firebid is a community marketplace that lets Australian members list items for auction or buy-it-now and connect with other members. Firebid is a venue — we do not own, inspect, ship, or guarantee items, and we do not act as an escrow or payment processor for member-to-member transactions. All transactions are private agreements between the buyer and seller, and members are solely responsible for meeting safely, inspecting items, and arranging payment and delivery.

4. Accounts

  • You must provide accurate information and keep your account details current.
  • You are responsible for activity under your account and for keeping your credentials confidential.
  • One account per person. Accounts are not transferable.

5. Seller membership and payment terms

Listing items for sale requires an active Seller Membership (currently A$9.99 per month, including a 7-day free trial for new sellers). Buying and bidding remain free.

Payments for the Seller Membership are processed by our payment provider, Stripe Payments Australia Pty Ltd. Stripe handles card processing, billing, tax calculation and collection, invoicing, and dispute handling on our behalf. Payment processing is subject to Stripe's Consumer Terms in addition to these Terms and our Refund Policy.

Memberships renew automatically each month until cancelled. You can cancel at any time through your account settings; access continues until the end of the current paid period. Existing live auctions you have created will run to completion even if your membership ends.

6. Listings and member conduct

You agree not to:

  • Use the Service for any unlawful purpose, fraud, scams, or spam.
  • List prohibited, counterfeit, stolen, unsafe, or recalled goods.
  • Infringe anyone's intellectual property, privacy, or other rights.
  • Interfere with the security or operation of the Service, including via malware, probing, scraping, or unauthorised automated access.
  • Manipulate bids (e.g. shill bidding) or attempt to bypass on-platform messaging or membership requirements.
  • Harass, threaten, or abuse other members.

You are solely responsible for your listings and for ensuring transactions comply with Australian Consumer Law and any other applicable laws.

6a. Completing a deal and mutual contact reveal

When an auction ends, the winner and the seller can each choose to tap "Ready to proceed" on the auction. When both parties have tapped Ready, Firebid will show each of you the other's verified mobile number so you can arrange payment, pickup or postage directly. Numbers are never shared automatically and are never shared with anyone else. A verified mobile on your profile is required. By using this feature, you agree to only use the shared number to complete this specific transaction, and not for marketing, spam, harassment, or on-selling. Misuse may result in suspension or a permanent ban.

7. Intellectual property

The Service, including its software, design, branding, and content created by us, is owned by Carey Ross Lee and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You retain ownership of content you submit (such as listing photos and descriptions) and grant us a worldwide, royalty-free licence to host, display, and process that content solely to operate and promote the Service.

8. Service level and warranties

We work to keep the Service available, but we do not guarantee it will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these Terms excludes or limits rights you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or exemplary damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service is capped at the greater of (a) the fees you paid us in the 12 months before the event giving rise to the claim, or (b) A$100. We are not liable for disputes between members or for the condition, legality, or delivery of items traded through the Service.

10. Suspension and termination

We may suspend or terminate your access to the Service, immediately and without notice, for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends, but sections that by their nature should survive (IP, liability, governing law) will continue to apply.

11. Indemnity

You agree to indemnify and hold Carey Ross Lee harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your listings, your use of the Service, your dealings with other members, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use of the Service after changes take effect means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales and the Federal Court of Australia have non-exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service.
